STARTING FROM 2024 INTRODUCTION OF PENALTIES FOR FAILURE TO REGISTER IN THE AIRE LISTS

Recalling that registration in the AIRE lists is an obligation for Italian citizens residing abroad and a fundamental prerequisite for access to consular services, it should be noted that the new Italian Financial Law of 30 December 2023, no. 213, starting from 2024, has introduced important innovations on the subject. In particular, art. 1 paragraph 242, amending Law no. 1228 of 24 December 1954, introduces administrative pecuniary sanctions. The competent authority for the assessment and imposition of the sanction is the municipality in whose registry the offender is registered. The assessment and sanctioning procedure for municipalities is governed by Law no. 689 of 24 November 1981, Article 1 of which provides that “No one may be subject to administrative sanctions except by virtue of a law that came into force before the violation was committed”. Further information can be obtained from your Italian municipality (Comune di iscrizione).
